IV.   ABATEMENTS:
  1. All abatements are effective the first of the month following the 30 calendar days granted.  The abatement date is listed on the annual/renewal failed letter.  HUD regulations do not allow the release of HAP payments without a passed inspection report.
  2. If the Inspection Division is notified that repairs are completed prior to the abatement date, but the re-inspection cannot be performed until after the abatement date, the HAP payment will still be abated effective the 1st of the abatement month.
  3. If the unit passes after the abatement date, the HAP payment will be effective back to the notification date that repairs were completed.  RHA does not penalize the owner or owner’s representative for the delay in scheduling.  If the unit passes at re-inspection, the HAP payment will be retroactive to the most recent notification date that repairs were completed.  If the unit still fails the inspection, the abatement of the HAP payment will remain in effect until the unit passes.
  4. After 90 calendar days from the date of the failed inspection (HAP payment already in abatement), the Inspection Division will send the failed inspection report back to the Leased Housing Section 8 Office.  The Inspection Division will not be allowed to reschedule this inspection without the approval from the Director or Assistant Director of Leased Housing.
