X.     Glossary of Terms:

Abatement - Stopping HAP payment to owner or owner’s representative.

Annual/Renewal Inspection - Must be performed prior to 12 months from last inspection, consistent with the anniversary date of HAP contract.

Complaint/Special Inspection - Where at least one party thinks another has failed to carry out his or her responsibilities (owner or owner’s representative, tenant, agency, or third party).

Consistently Has Units Not Ready - An owner or owner’s representative that repeatedly has units not ready which result in the need for a re-inspection. Refer to Substantially Not Ready.

Housing Quality Standard (HQS) - HUD minimum quality standards for tenant-based programs that apply to the building and premises, as well as the unit.  HUD requires an HQS inspection both at initial/new occupancy and during the term of the lease (annual/renewal).

Inconclusive - The unit was not ready for inspection and/or re-inspection. Examples include but not limited to, utilities not on and/or the unit was substantially not ready and/or the inspector saw numerous obvious HQS violations upon arrival. The inspection is not performed and a repair list will not be generated. A notification that the inspection was inconclusive will be sent to the owner and/or owner representative.

Initial/New Inspection - Referred to also as a move-in inspection.  Conducted upon receipt of a Request for Tenancy Approval from the housing counselor.  Inspection conducted to determine that the unit meets all housing quality standards and that the rent is reasonable.

Inspection - Interior and exterior physical means of monitoring and enforcing housing quality standards.

Owner or Owner's Representative - This term means either the owner of the property or his/her representative or the managing agent or his/her representative, as shall be designated by the owner of who has legal right to lease or sublease said property. Also referred to as landlord.

Quality Control Inspections - Inspections performed by supervisor or lead inspector to determine that inspections are adhering to housing quality standards and are providing consistent determinations on approved units.  Sampling of inspections, cross-section of neighborhoods, and work of all inspectors.

Recertification - Determination of eligibility by family income and composition required annually to be consistent with anniversary of HAP contract.

Re-inspection - Any inspection other than the first inspection scheduled to confirm that all failed items have been repaired.

Rent Reasonableness - Method used to determine that the rent is reasonable by comparing location, size, type, quality, and age of the unit to be leased with the amenities, housing services, and maintenance and utilities provided by the owner or owner’s representative.  HUD requires that a rent reasonableness be done prior to placing a new unit under HAP contract, before any increase of rent is granted to the owner or owner’s representative, and if there is a 5% decrease in the published fair market rent (FMR) in effect 60 days before the contract anniversary as compared with the FMR in effect one year before the contract anniversary.

Safety/Health Hazard/Life Threatening - Examples to include but not limited to:  exhaust fumes from heating system, no heat in winter months, exposed wiring, a condition at no fault of the tenant’s that causes loss of electricity and/or water.

Substantially Not Ready - The owner or owner’s representative knew or should have known that the unit was not ready for inspection.  Examples to include but are not limited to: owner or owner’s representative doing repairs when inspector arrives, missing appliances, utilities not on, numerous HQS violations and/or the owner did not show up for scheduled inspection.
